A New Regulation Affecting Both Tenants and Homeowners Has Begun
The recent hikes in housing fees have led to a new regulation affecting both tenants and homeowners. From now on, the portion of the fees exceeding the rental amount will be the responsibility of the homeowners. This change aims to create a fairer process for fee increases.
NEW REGULATIONS AGAINST FEE HIKES
Recently, high increases in housing fees have been widely discussed. According to the new regulation, fees will now be determined solely by the budget approved at the general assembly of the property owners. This process will be fully open to supervision, ensuring transparency.
HOMEOWNERS WILL BE RESPONSIBLE FOR FEES EXCEEDING THE RENT AMOUNT
With the new regulation, tenants’ fee obligations will be limited to the rent amount. For example, if a tenant pays 15,000 TL in rent and the housing fee is set at 20,000 TL, the tenant will only pay the 15,000 TL portion. The remaining 5,000 TL will be covered by the homeowner. This regulation provides significant relief, especially for tenants in luxury housing projects.
MAJOR EXPENSES WILL NOW BE THE RESPONSIBILITY OF HOMEOWNERS
Tenants will only be held responsible for usage-related expenses. Major expenses such as elevator renewals, insulation, reinforcement works, and employee severance payments will be entirely the responsibility of the homeowners. Charging these costs to tenants is considered illegal according to the rulings of the Court of Cassation.
TENANTS’ LEGAL RIGHTS ARE STRENGTHENED
Under the new regulation, tenants will be able to file a lawsuit within one month against unlawful fee increases or cost demands, defending their rights. Furthermore, clauses in rental contracts such as "All fees and costs are the tenant’s responsibility" will be deemed invalid. This will allow tenants to protect their rights more effectively.
THE REGULATION AIMS TO ENSURE FAIRNESS IN FEE PAYMENTS
This new regulation aims to ensure fairness in housing fee payments. The goal is to increase homeowners’ responsibilities while reducing the financial burden on tenants. Additionally, making fee increases subject to legal oversight provides a solution to chronic problems in the sector.
