Social media posts can have legal consequences. A recent incident in Turkey led to the establishment of a precedent-setting decision for individuals facing similar situations.

A person who shared a photo taken with a friend without their permission and added an insulting comment was sentenced to prison. The Court of Cassation also upheld the decision.

PRISON SENTENCE FOR UNSANCTIONED PHOTO SHARING

In the case brought to court, a person shared a photo taken with a friend on social media without their consent. However, due to the insulting comment added to the post, the person in the photo filed a lawsuit. The first-degree court issued an acquittal. However, after the case was transferred to the Regional Court of Appeal, the decision was changed. The court sentenced the defendant to 1 year and 8 months in prison for "illegally spreading personal data."

SUPREME COURT CONFIRMS THE DECISION

The defendant appealed the sentence, arguing that the photo was taken with the friend's consent and therefore no crime was committed. However, the 12th Criminal Chamber of the Court of Cassation rejected the appeal and upheld the prison sentence. Thus, the decision became final.

This decision once again highlights that social media posts can lead to legal responsibility. Especially unauthorized sharing of other people's photos can result in legal penalties.
